It’s easy to forget these days, but former President George W. Bush’s illegal warrantless surveillance program was never halted by Congress, nor by the Obama administration. It was merely legalized in a 2008 law called the FISA Amendments Act. That means the surveillance of Americans’ international phone calls and internet use — complete with secret rooms in AT&T data centers around the country — is likely still ongoing.

On Monday, a federal appeals court reinstated a key legal challenge to that surveillance: a lawsuit filed by the ACLU and others within hours of the FISA Amendments Act (.pdf) being signed into law. The lawsuit attacks the constitutionality of the legislation, which allows the government to electronically eavesdrop on Americans without a probable-cause warrant, so long as one of the parties to the communication resides outside the United States, and is suspected of a link to terrorism.

The decision by the 2nd U.S. Circuit Court of Appeals means the ACLU, and other rights groups involved in the suit, might get their day in court. “This is a really big victory,” said ACLU spokeswoman Rachel Myers. “The ruling is that you don’t have to prove you’ve been spied on to challenge an unlawful spy act.”

Supreme Court Lets Fed Bailout Records Release Stand

The Supreme Court let stand a ruling that the U.S. Federal Reserve must disclose details about its emergency lending programs to banks during the financial crisis in 2008.

A group representing major commercial banks had asked the high court to reverse a ruling by a federal appeals court that required disclosure of the lending records.

The justices rejected the banks' appeals. The Obama administration said the appeals should be denied.

It said the financial overhaul law adopted last year set new standards on releasing information about emergency lending programs and the law required the disclosure in December of much of the data at issue in the cases.

Colonel Gaddafi suffered a massive personal setback today when one of his sons was allegedly killed in a suicide air mission on his barracks.

Khamis, 27, who runs the feared Khamis Brigade that has been prominent in its role of attacking rebel-held areas, is said to have died on Saturday night.

A Libyan air force pilot crashed his jet into the Bab al-Aziziya compound in Tripoli in a kamikaze attack, Algerian TV reported following an unsubstantiated claim by an anti-Gaddafi media organisation.

Khamis is alleged to have died of burns in hospital. The regime denied the reports.

It was claimed he died in the same compound hit by RAF cruise missiles hit by coalition forces last night.

Loyalists have been photographed with shrapnel from the missile that struck the building and throughout the day there has been no information on Gaddafi's whereabouts.

Well it depends on your definition of declaring war: 'a conflict carried on by force of arms, as between nations or between parties within a nation.'

Supporters of Obama's attack would say this is not an attack from the US on Libya but the UN or NATO on Libya but we are just assisting. In this case Bush would not have declared 'war' either because it was a collective with NATO forces in the beginning.

Others would say we are still declaring war from the US on Libya by using our armed forces against another country. No question this would be a declaration of war, spoken or unspoken. In this case, it would be unconstitutional and should have gone through Congress.

At least Congress did vote on acts of resolution against Iraq even if it wasn't a full declaration of war which would have solve Bush's problems.

NOW THE BUSH DOCTRINE HAS BEEN ADOPTED BY OBAMA AND CONGRESS IS LEFT OUT OF THE DECISION MAKING AGAIN, BEING UNCONSTITUTIONAL EVEN MORE THAN THE IRAQ WAR. TO ALL LIBERALS, TIME TO CALL ON OBAMA'S IMPEACHMENT, HE IS NO LONGER A LEGITIMATE PRESIDENT.
